I had a car accident in Albania.

Where should I go to withdraw the value of the indemnity?

  1. In case the vehicle causing the accident is uninsured or unidentified, you should immediately contact the Albanian Insurance Bureau for the award of compensation.
  2. In case the vehicle causing the accident is insured with TPL or Border insurance policies at an insurance company, then you should immediately contact this insurance company for the award of compensation.
  3. If the vehicle that caused the accident is insured with a Green Card at a foreign insurance company, you should contact the Albanian Insurance Bureau again for the award of the indemnity value.

What are the deadlines for handling, assessing and paying for a damage practice resulting from an accidental event?

The deadlines for handling the claim for compensation are provided in Regulation No. 53, dated 25.06.2009 of the amended AFSA, as follows:

  • For non-property (health) damage, within 90 days from the date of completion of the documentation accompanying the claim for compensation.
  • For property damage, within 30 days from the date of receipt of the claim for compensation.

How is the value of compensation for the injured party in an accident within the territory of the Republic of Albania calculated?

  1. In case of car accident with consequence only material damage, the calculation of the compensation value is done in accordance with Regulation No. 53, dated 25.06.2009 of the Financial Supervisory Authority
  2. In case of a car accident resulting in damage to health or loss of life, the value of compensation is calculated on the basis of this Regulation, taking into account the criteria of the injured party as follows:
  • Personal income
  • Age at the time of the accident
  • Retirement age coefficient
  • Capitalized amount coefficient
  • Coefficient of loss of ability at work, etc.

What are the necessary documents for opening a damage practice at the Albanian Insurance Bureau?

In accordance with the Law “On compulsory insurance in the transport sector” and Regulation No. 53, dated 25.06.2009 of the AFSA, in case of involvement in a road accident, the relevant documentation must be completed and submitted to receive compensation.

The party injured in the accident, depending on the type of damage suffered must complete the following documentation depending on:
A. Health Damages
B. Material Damages

A. Documents for health damage

Documents for health damages are divided as follows:

A.1. General Documents

Notice / Claim for compensation at the Albanian Insurance Bureau
Confirmation of insurance coverage issued by the insurance company of the vehicle causing the accident.
Minutes of the violation by the Traffic Police for the event.
Decision of the Prosecution / Court on the event, when the accident results in serious injuries or death.
The final decision of the Court on liability in the accident, when one of the drivers of the motor vehicle involved in the accident results in death or serious injury, or the decision of the Prosecution when the case is dismissed.

A.2. Specific documents:

a. Family Certificate and Identity Card / ID.
b. Proof of net personal income for the last three years

A.3. For health damage resulting in death

in addition to those provided in points 1 and 2, the following documents will be included:
a. Death file;
b. Death certificate.
c. Court decision to determine the heirs of the deceased.

A.4. For health damage with permanent disability

in addition to those provided in point 1 and 2, the following documents will be included::
a. The report of permanent incapacity for work which must be expressed in
percentage of the degree of disability, based on the table “Degree of
loss of permanent incapacity for work ”;
b. Radiography / Scanner / Magnetic resonance / epicrisis / anamnesis, leaflet
and discharge from the hospital and any other documents assisting in
damage assessment issued by the competent authorities.

A.5. health damage with temporary disability

in addition to those provided in points 1 and 2, the report of temporary disability will be included, which must be according to the Type Model issued by the competent body.

B. Documents for material damage

Documents for material damages are divided as follows:

B.1. General Documents:

a. Notification / claim of the injured party for registered compensation
at the insurance company;
b. Confirmation of insurance coverage by the insurance company of the vehicle
cause of damage;
c. Event Friendly Certification Form;
d. Minutes of the ascertainment of the violation by the Traffic Police for the event;
e. The decision of the Prosecution for the event, when the accident results in death
and / or serious injuries;
f. The final decision of the court (for liability in the accident, when one of the drivers of the motor vehicle involved in the accident results in death or serious injury), or the decision of the prosecution when the case is dismissed.

B.2. Specific documents

a. Document of ownership of the damaged vehicle or object;

d. Photos of the damaged vehicle or object;
e. Indemnity claim model
